Supreme Court: Agency heads

Summary

This decision gave the president the ability to fire the heads of agencies with regulatory or enforcement authority for any reason, even if Congress had specified that the head can be fired only for specified causes.

How did this case come about?

The Consumer Financial Protection Bureau (CFPB) was investigating Seila Law.

In appealing a district court decision that it must turn over documents, the company claimed the CFPB itself is unconstitutional - because the Constitution gives the President full control of the Executive Branch, but the agency has a single director that could not be removed at the President's discretion.

Agency still constitutional

While the decision allows the President remove the head of an agency at their discretion, the court also ruled that the agency is constitutional.
